Sex Discrimination and Sexual Orientation Discrimination
Sex discrimination is based on whether a person is biologically a man or woman. Sexual harassment and hostile work environment are types of sex discrimination. A hostile work environment occurs when sexual harassment is so pervasive that it affects your ability to do your job.
You can be sexually harassed by a supervisor, a co-worker or a third party. The harasser may be a member of the opposite sex or same sex. Sexual harassment at work can include sexual remarks, e-mail messages, offensive jokes, threats or sexual photographs.
Sexual orientation discrimination is also a type of sex discrimination. It is based on an individual being lesbian, gay, bisexual or transgender. Under New York law, it is illegal to fire or otherwise discriminate against an employee based on his or her sexual orientation.
